1. Acceptance of Terms
By accessing or using CircusAI Coach ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms are governed by the laws of the Province of Ontario, Canada. Users in the United States agree that disputes shall be resolved under Canadian law, without regard to conflict of law principles.
2. Description of Service
CircusAI Coach provides AI-generated circus arts training plans, video recommendations, and a marketplace connecting students with independent coaches. The Service is operated from Canada and is available to users worldwide.
3. Accounts and Registration
You must create an account to access certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must be at least 13 years of age to create an account. If you are under 18, a parent or guardian must consent to these terms on your behalf.
4. Subscription and Payments
Premium access is billed at $9.00 USD per month. Payments are processed through Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. All prices are in USD unless otherwise stated. We reserve the right to change pricing with 30 days notice.
5. AI-Generated Content
Training plans are generated by artificial intelligence and are provided for informational purposes only. They are not a substitute for professional coaching, medical advice, or qualified in-person instruction. You use any AI-generated training content entirely at your own risk. Always consult a qualified instructor and medical professional before beginning any new physical training program.
6. Physical Activity Waiver
By using the training plan features of this Service, you acknowledge the inherent physical risks of circus arts training including but not limited to falls, muscle injury, joint injury, and in rare cases serious injury or death. You waive any claims against CircusAI Coach arising from your participation in activities suggested by the platform, to the fullest extent permitted by applicable law in Canada and the United States.
7. Coach Marketplace
CircusAI Coach acts as a marketplace only. Coaches listed on the platform are independent contractors and are not employed by CircusAI Coach. We do not verify coach credentials, qualifications, or conduct. Any arrangement between you and a coach is a direct agreement between you and that coach. CircusAI Coach is not liable for the conduct, advice, or actions of any coach.
8. Referral Program
Premium users may participate in our referral program and earn $1.80 USD per referred user who becomes a paying subscriber. Commissions are paid monthly with a minimum payout of $18.00 USD. CircusAI Coach reserves the right to modify or terminate the referral program at any time with 30 days notice. Fraudulent referrals will result in account termination.
9. Intellectual Property
All content, software, and technology on the Service is the property of CircusAI Coach or its licensors. You may not copy, reproduce, or distribute any part of the Service without written permission. AI-generated training plans are licensed to you for personal use only.
10. Prohibited Conduct
You agree not to misuse the Service, including but not limited to: submitting false information, attempting to circumvent payment, creating fake accounts for referral fraud, using the Service for commercial redistribution, or engaging in any conduct that violates applicable law.
11. Limitation of Liability
To the maximum extent permitted by applicable law (including Canadian and U.S. federal and state law), CircusAI Coach shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues. Our total liability to you for any claims under these terms shall not exceed the amount you paid us in the 12 months preceding the claim.
12. Termination
We may suspend or terminate your account at any time for violation of these terms. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.
13. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes by email or through the Service. Continued use after changes constitutes acceptance of the new terms.
